This document is a Terms of Use draft for VoteMyVoice MVP. It should be reviewed by a qualified attorney before public launch, particularly regarding liability limitations, CCPA/Texas privacy law compliance, and applicable election law requirements.
1 Acceptance of Terms
These Terms of Use ("Terms") govern your access to and use of the VoteMyVoice mobile application and any associated services (collectively, the "Service"). By using the Service, you confirm that you have read, understood, and agree to be bound by these Terms and our Privacy Policy, which is incorporated herein by reference.
We may update these Terms from time to time. Continued use of the Service after changes are posted constitutes acceptance of the revised Terms. We will notify users of material changes via in-app notice.
2 Eligibility
VoteMyVoice is intended for use by:
- Individuals who are 18 years of age or older; or
- 17-year-olds who will be 18 by the date of the next election, as permitted for voter pre-registration purposes in Texas.
By using the Service, you represent and warrant that you meet these eligibility requirements. If you are under 13 years of age, you may not use the Service.
3 Description of Service
VoteMyVoice is a civic information tool that helps voters in Texas:
- Check voter registration status via links or in-app lookups to official state systems.
- View candidates and races appearing on their ballot based on their address or county.
- Access publicly available campaign finance information sourced from the FEC and other public data providers.
- View key election dates, early voting schedules, and polling place information.
- Complete an issues quiz to explore alignment between their preferences and candidate positions.
VoteMyVoice is an informational service only. It is not an official election authority, does not provide legal advice, and does not constitute an endorsement of any candidate, party, or political position. Always verify critical voting information with your county election office or the Texas Secretary of State.
4 Informational Use Only โ No Warranty on Data Accuracy
Candidate and election data displayed in VoteMyVoice is sourced from third-party public data providers including the FEC, Open States, the Texas Secretary of State, and county election offices. While we make reasonable efforts to keep this data current and accurate, we make no representations or warranties regarding the completeness, accuracy, or timeliness of any data displayed.
You should independently verify any information that is material to your voting decisions by consulting official sources:

5 Acceptable Use
You agree to use VoteMyVoice only for lawful, personal, non-commercial purposes. You must not:
- Scrape, crawl, or use automated means to access or extract data from the Service.
- Attempt to reverse-engineer, decompile, or tamper with the app or its underlying infrastructure.
- Use the Service to harass, impersonate, or harm any individual or organization.
- Submit false address or identity information to manipulate ballot data results.
- Use the Service in any way that violates applicable federal, Texas state, or local law, including any election laws.
- Attempt to interfere with or disrupt the Service or its servers.
We reserve the right to suspend or terminate access for any user who violates these Terms.
6 Intellectual Property
All content, design, code, trademarks, and materials in VoteMyVoice โ excluding publicly sourced government data โ are the property of VoteMyVoice and are protected by applicable intellectual property laws. You may not reproduce, distribute, or create derivative works from any proprietary content without our express written permission.
Publicly sourced data (FEC filings, Open States data, Texas SOS records) remains in the public domain and subject to the respective providers' terms of use.
7 Third-Party Services and Links
The Service may display links to external websites and transmit data to third-party APIs to fulfill its functions. These third parties have their own terms of service and privacy policies.

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
We do not warrant that the Service will be uninterrupted, error-free, or available at any particular time; that data displayed will be accurate, complete, or up to date; or that the Service will meet your specific requirements. Some jurisdictions do not allow the exclusion of implied warranties, so the above may not fully apply to you.
9 Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, VOTEMYVOICE AND ITS OWNERS, OPERATORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICE, INCLUDING BUT NOT LIMITED TO:
- Reliance on inaccurate or incomplete voter, candidate, or election data.
- Failure to receive timely election reminders or notifications.
- Inability to access the Service during a critical election period.
- Any decisions made based on information provided by the Service.
Our total liability to you for any claims arising from your use of the Service shall not exceed $10.00 USD.
10 Indemnification
You agree to indemnify, defend, and hold harmless VoteMyVoice and its operators from and against any claims, liabilities, damages, losses, or expenses (including reasonable legal fees) arising out of or in any way connected with your use of the Service, your violation of these Terms, or your violation of any third-party rights.
11 Governing Law and Dispute Resolution
These Terms are governed by and construed in accordance with the laws of the State of Texas, without regard to its conflict of law principles. Any dispute arising from or relating to these Terms or your use of the Service shall be resolved exclusively in the state or federal courts located in Texas, and you consent to the personal jurisdiction of such courts.
12 Termination
We reserve the right to suspend or terminate your access to the Service at any time, with or without notice, for any reason, including violation of these Terms. You may stop using the Service at any time. Sections 4, 6, 8, 9, 10, and 11 survive any termination.
13 Changes to the Service
VoteMyVoice is an evolving product. We may modify, suspend, or discontinue any feature or the Service itself at any time without prior notice or liability. We are not obligated to maintain any particular feature, data source, or coverage area.
