Terms of Use

1. Acceptance of terms

These Terms govern your use of the VoteMyVoice mobile app and related services (the "Service"). By using the Service you agree to these Terms and to our Privacy Policy. We may update these Terms. We will update the date above and, for material changes, tell you in the app. Continuing to use the Service after a change means you accept it.

2. Eligibility

VoteMyVoice is intended for people who are 18 or older, or who are 17 and will be 18 by the next election, as Texas permits for voter registration. If you are under 13 you may not use the Service.

3. What the Service does

VoteMyVoice helps Texas voters:

• See the races and candidates on their ballot, based on the address they enter (or a county, for browsing).
• See key election dates, and polling place and early voting locations where available.
• Review candidates' campaign finance information and outside spending drawn from public filings.
• Take an issues quiz and see how candidates' positions line up with their priorities.
• Follow links to official sources, such as the Texas Secretary of State, to check their voter registration. Texas has no public registration lookup, so the registration status shown in the app is whatever you tell us. It is not verified.

You can use the app as a guest, or create an account to save your information.

4. Informational use only — no warranty on accuracy

Information in the app comes from public sources, including the Federal Election Commission (FEC), the Texas Ethics Commission (TEC), the Texas Secretary of State, county election offices, the Google Civic Information API, candidates' own materials, and news indexes. Candidate summaries and issue positions are prepared from public information, may be incomplete or out of date, and "alignment" scores are only an estimate based on that information and on your quiz answers. Campaign finance figures reflect filings made so far and can change as reports are filed or amended. We make no representation or warranty that any information is complete, accurate or current. Please verify anything that matters to your vote:

Campaign finance and contributor information is shown for information about elections only. Federal and Texas law restrict using contributor names and addresses from these filings to solicit contributions or for commercial purposes. You may not use the app for those purposes.

5. Your account

You are responsible for keeping your sign-in details private and for activity on your account. Give us accurate information. You can delete your account at any time in Settings, which permanently removes your profile, quiz results and sign-in (see the Privacy Policy).

6. Acceptable use

Use VoteMyVoice only for lawful, personal, non-commercial purposes. You must not:

• Scrape, crawl, or use automated means to extract data from the Service.
• Reverse-engineer, decompile, or tamper with the app or our systems.
• Harass, impersonate, or harm any person or organization.
• Enter someone else's address or details to see or save their information without permission.
• Use the Service in a way that violates federal, Texas or local law, including election laws.
• Interfere with or disrupt the Service or its servers.

We may suspend or end access for anyone who violates these Terms.

7. Intellectual property

The app's design, code, text and branding belong to VoteMyVoice and are protected by law. Public government data (such as FEC and TEC filings) remains subject to its providers' terms. Candidate photos shown in the app are official public-domain portraits where we have them. You may not copy or redistribute our proprietary content without written permission.

8. Third-party services and links

The app uses outside services to work, and links to outside sites. They have their own terms and privacy practices, and we are not responsible for them.

9. Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE", WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED OR ERROR-FREE OR THAT ANY INFORMATION IS ACCURATE, COMPLETE OR UP TO DATE. Some places do not allow these exclusions, so they may not fully apply to you.

10. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, VOTEMYVOICE AND ITS OWNERS, OPERATORS AND AGENTS ARE NOT LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF THE SERVICE, INCLUDING RELIANCE ON INACCURATE OR INCOMPLETE VOTER, CANDIDATE OR ELECTION INFORMATION; MISSING A DEADLINE OR ELECTION; INABILITY TO ACCESS THE SERVICE; OR ANY DECISION YOU MAKE BASED ON IT. OUR TOTAL LIABILITY FOR ANY CLAIM IS LIMITED TO US$10.

11. Indemnification

You agree to defend and hold harmless VoteMyVoice and its operators from claims, losses and expenses (including reasonable legal fees) arising from your violation of these Terms or of anyone's rights.

12. Apple

If you downloaded the app from the Apple App Store, these Terms are between you and VoteMyVoice, not Apple. Apple has no obligation to provide support or maintenance for the app. Apple's standard licensed-application terms also apply to your use of the app on Apple devices.

13. Governing law

These Terms are governed by the laws of the State of Texas, without regard to conflict-of-law rules. Disputes will be resolved exclusively in the state or federal courts located in Texas, and you consent to their jurisdiction.

14. Termination and changes to the Service

You may stop using the Service at any time. We may suspend or end your access, or change or discontinue any feature or data source, at any time. Sections 4, 7, 9, 10, 11 and 13 survive termination.
